2.3 User Responsibilities: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify Traivel immediately of any unauthorized use of your account.

3. BOOKINGS AND PAYMENTS

3.1 Bookings: All bookings made through Traivel are subject to availability and the terms and conditions of the third-party service providers. Traivel does not guarantee the availability of any travel service.

3.2 Payments: Payments for bookings must be made through the payment methods provided on the Traivel platform. You agree to pay all charges incurred by users of your account at the prices in effect when such charges are incurred.

3.3 Cancellations and Refunds: Cancellation and refund policies vary depending on the third-party service provider. Please review the specific policies before making a booking. Traivel is not responsible for any cancellations or refunds.

3.4 Price Difference: Traivel is not responsible for inventory price differences between the web platform (Traivel.io) and third-party service providers. The price for the same routes and the same fares may differ depending on the time left to departure, ticket availability, and other factors. 4. USE OF THE SERVICES

4.1 License: Traivel grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes.

4.2 Prohibited Activities: You agree not to: (a) use the Services for any illegal purpose or in violation of any local, state, national, or international law; (b) harass, threaten, demean, embarrass, or otherwise harm any other user of the Services; (c) interfere with or disrupt the Services or servers or networks connected to the Services.

5. CONFIDENTIALITY AND DATA PROTECTION

5.1 Confidentiality: You agree to keep confidential all non-public information and materials about Traivel’s business, products, and services that you learn through your use of the Services.

8.2 Limitation of Liability: To the maximum extent permitted by law, Traivel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services.

You agree to indemnify, defend, and hold harmless Traivel and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

11. GENERAL PROVISIONS

11.1 Entire Agreement: These Terms constitute the entire agreement between you and Traivel regarding the use of the Services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

11.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Traivel’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without Traivel’s prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. Traivel may freely assign or transfer these Terms without restriction.

12. MESSAGING TERMS & CONDITIONS

12.1 General: When you opt-in to the service, we will send you a message to confirm your signup. By opting into messages, you agree to receive recurring automated marketing and informational text messages from Traivel for Traivel Notification (including reminders about what you left in your online shopping cart). Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Traivel Notification. Traivel reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Traivel also reserves the right to change the short code or phone number where messages are sent.

Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.

Your consent to receive marketing messages is not a condition of purchase. Marketing messages may include abandoned shopping cart reminders. Traivel uses cookies to help track items in your shopping cart, including when you have abandoned your shopping cart prior to checkout. This information is then used to determine when to send you a cart reminder message.

12.2 Carriers: Carriers are not liable for delayed or undelivered messages. You can cancel any time by texting "STOP". After you send the SMS message "STOP", we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Traivel again, just sign up as you did the first time and Traivel will start sending messages to you again.

12.4 Transfer of Number: You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or notify us of your old number at info@traivel.io. The duty to inform us based on the above events is a condition of using this service to receive messages.

12.5 Privacy: If you have any questions about your data or our privacy practices, please visit our Privacy Policy.

12.6 Messaging Terms Changes: We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrollment following such changes shall constitute your acceptance of such changes
